Mediation

Mediation, which entered the Turkish legal system through the Law No. 6325 on Mediation in Civil Disputes dated 7 June 2012, is a voluntary dispute resolution method conducted with the participation of an impartial and independent third party who has received specialized training. Through the application of systematic techniques, the mediator brings the parties together to communicate, discuss, and negotiate, facilitates the establishment of a communication process between them, helps them better understand one another, and enables them to produce their own solutions. A mediator refers to a real person registered in the official mediators registry organized by the Ministry and authorized to conduct mediation activities.

Today, mediation is one of the most widely known and practiced amicable dispute resolution methods. It is an alternative dispute resolution mechanism in which an impartial third party facilitates communication and negotiation between the parties for the resolution of disputes arising in the field of private law. Through mediation, parties may resolve their disputes without resorting to court proceedings or may prefer mediation during ongoing litigation processes.

Mediation aims to identify the core dispute and underlying interests between the parties, encourage discussion on these matters, and help the parties generate their own solutions while fostering mutual understanding. In resolving disputes through mediation, parties are entirely free to apply to a mediator, continue the process, finalize it, or withdraw from it at any stage. No party may be forced into the mediation process under any circumstances.

Mediation is effectively used because disputes can be resolved in a shorter period of time and at lower cost compared to court proceedings, while also preserving healthy relations between the parties and enabling effective decisions to be reached.

In this context, in order to provide services that enable legal disputes to be resolved quickly and efficiently without resorting to court proceedings, thereby preventing loss of time and reputation, applications may be submitted to the Ankara Chamber of Industry Arbitration, Mediation and Conciliation Center (ASOTAUM). You may complete the application form available on our website and send it to asotaum@aso.org.tr. Following receipt of your application by our Chamber, one of the mediators from our mediator list will contact you as soon as possible, taking into consideration the nature of your dispute, and mediation meetings will be conducted at our Chamber in a secure and comfortable environment.
